Guerra & Partners Prevails In Summary Judgment

George Guerra and Chemere Ellis won summary judgment on behalf of their clients in a commercial business dispute. The matter involved breach of contract claims filed against our clients, an individual and several of his corporate entities, in Hillsborough County Circuit Court.

Guerra & Partners Honors Asian American, Native Hawaiian, and Pacific Islander Heritage Month

May is Asian American, Native Hawaiian, and Pacific Islander Heritage Month. Congress first established Asian American and Pacific Islander Heritage Month in 1992. The month of May was selected due to the arrival of the nation’s first Japanese immigrants on May 7, 1843, and Chinese workers’ pivotal role in building the transcontinental railroad (completed May 10, 1869). In 2021, it was expanded to include Native Hawaiians.

Although Memorial Day weekend is filled with barbeques, pool parties, and the celebration of the start of Summer, Memorial Day is a day to honor the courageous men and women who have died in service to our country. The holiday was originally known as “Decoration Day,” and originated as early as the late 1860s after the end of the Civil War.

Guerra & Partners Prevails On FINRA Eligibility Motion

On April 5th, shareholder Ailen Cruz successfully argued a Motion to Dismiss based on eligibility in a FINRA customer arbitration.  Although FINRA arbitration rules prohibit time-barred claims from proceeding in arbitration, arbitrators have been conspicuously less inclined to dismiss ineligible claims in recent years due  – in part – to increasingly creative pleadings and arguments from claimants that are designed to avoid dismissal.

Are Non-Compete Agreements Still Valid In Florida?

On January 5, 2023, the Federal Trade Commission (“FTC”) proposed a rule banning non-competition clauses in employment agreements. Approximately one in every five American workers, or 30 million people, are subject to a non-compete agreement.
